This agreement is valid for services provided over the internet and consists of rules that determine the terms of web hosting, data center and software use between real persons or legal entities and Gyro Hosting Hizmetleri. Before ordering any product from our website, you must read the service agreement and the terms of use, which are an integral part of this agreement, in full. The service use agreement includes the rules you must comply with. If you do not accept this agreement or any of its terms, please cancel your order transactions. Do not order any products or services.

Service Provider and Parties
This agreement is made between Gyro Information Technologies and Software Services (hereinafter referred to as “Gyro Information Services”) and customers who purchase the services provided by Gyro Information Services (hereinafter referred to as “customers”).

Subject of the Agreement
The subject of this agreement determines the terms of use of the service provided by Gyro Hosting Hizmetleri, such as rented server, virtual server (vps/vds/ssd vds etc.), cloud server services.

Information
Gyro Hosting Hizmetleri aims to provide more secure services to its customers by applying globally accepted standards.

Content Permissions
The use of all services provided by Gyro Hosting Hizmetleri must be in accordance with international law rules and customs and international agreements to which the Republic of Turkey is a party. Gyro Hosting Hizmetleri is not obliged to inform its customers about legal changes. Services can only be used within legal permissions. All our customers who benefit from our services accept, declare and undertake with this agreement that all content or applications they publish and/or run are in compliance with the law and do not prevent or harm the rights and freedoms of other real or legal persons. It is forbidden to violate copyright or trademark in the services provided by Gyro Hosting Hizmetleri. Copyrights cover all kinds of rights violations that may occur, such as copying of any content that is in the nature of a work or not, such as videos, music, books or photographs, etc. In case of unauthorized publication of the products of the trademark owner or the person who violated the rights, the accounts of the customer or legal entity will be terminated when officially notified to Gyro Hosting Hizmetleri.

Restrictions
Examples of transactions that are not allowed in all our services are given below;

     • IRC Scripts and Bots

     • DHCP Server (DHCP Server Installation is Not Allowed Due to Our Network Structure. In order to Install DHCP, a Customer-Specific Infrastructure Must Be Prepared by Getting Information from Our Technical Team)

     • Proxy Scripts and Anonymizers

     • Pirated Software and Warez

     • AutoSurf, PTC, PTS and PPC Sites

     • IP Scanners

     • Bruteforce Programs, Scripts and Applications

     • Mail Bombers, Spam Scripts and Mailer Pro

     • Selling Items Without Proper Permissions

     • Adult, Erotic, Adult Story and Video Sites with All Kinds of Content

     • Escort, Gigolo Sites, Friendship Sites and All Sites with Such Content

     • Lottery and Gambling Sites

     • MUDs, RPGs and PBBGs

     • Archive Programs Focused on Hacker Sites

     • Illegal Activities Promotion Sites

     • All Content Contrary to the Laws of the Republic of Turkey.

Gyro Hosting Hizmetleri has the right to refuse service to any account holder. If a material you publish is obscene, threatening, illegal or in any way violates the service usage agreement, your service will be disabled with or without notice.

When you receive an e-mail from our Abuse (abuse) unit, you are obliged to respond to the notification via support ticket within 24 hours. If no response is received within 24 hours, the service may need to be suspended or terminated. In addition, according to law no. 5651, court decisions or TIB (Telecommunications Communication Presidency) decisions regarding access restriction will be implemented within 4 hours, regardless of day or night, without any need for any warning.

Spam or unsolicited e-mail sent in bulk together with the restrictions is strictly not allowed. Member v e-mails sent from databases, purchased mailing lists and mails sent to them are considered and accepted as spam. Accounts of customers who engage in these activities will be suspended without warning or will be restricted from sending e-mails, and the service will not be reactivated unless spam mail sending is stopped by the customer.

Gyro Hosting Hizmetleri reserves the right to close any service that does not comply with this agreement and to make changes in emergency cases according to its own situation.

It is strictly forbidden to publish content that could potentially harm minors, child pornography or similar perceived content is evaluated in this category. In the event that child pornography is hosted or reported on any site, an abuse notification will be made to our customer regarding the removal of the content, and if this happens again, the service will be terminated. If the situation is beyond the knowledge of the service owner, a 24-hour period is given for the content to be removed.

In the event of ddos ​​attacks, mail bomber, flood, ip spoffing and similar attacks that may occur on a service, the account is temporarily closed and the ip address under attack is immediately closed due to the fact that other service users are affected by this situation.

Backup and Data Loss
Our company does not take any backups for vds and dedicated servers. Customers are responsible for storing and preserving their own backups. In the backup operations to be taken for a fee, the backup contract terms written in our backup contract will be valid. Our company is absolutely not responsible for any possible data loss or problems.

Server Installations
The customer can freely choose the operating systems that can be installed on the server during the server order, for example: centos7, windows 10. Our company provides the ordered system by virtualizing the physical server with wmvare esxi̇ unless the customer specifically requests that it not be virtualized and virtualizes all the physical resources on the server and gives it to the server. While the physical server is physically given to the customer with the features written on our site, thanks to virtualization, there is no performance loss and in case of possible hardware failures, the server can be transferred to a different server with the ease provided by virtualization using the clone or migrate method.

However, if the customer does not want virtualization, the physical server can be installed without virtualization. For virtualized servers, esxi information is also shared with the customer. In this way, the customer can see that the server physically belongs to them.

Conditions Regarding Technical Support
Technical support requests are only accepted from the automation system and recorded here. Responses to technical support requests are also sent to the automation system in the same way as responses to support requests sent to the system.

Technical support is never provided over the phone. Our customers who send support requests can contact our team by phone and inform them that the issue is urgent or get information about the status of the support request. The solution, details and information of the problem are provided through the sent support request.

Gyro Hosting Hizmetleri can only provide support to its customers on issues related to its own business. Since the administrator password belongs to the customer, the management of the servers is not done by Gyro Hosting Hizmetleri. The content of the technical support that Gyro Hosting Hizmetleri will provide to the customer is listed below. Requests outside the scope of technical support included in the specified items are met by making a service level agreement.

A. The initial operating system installation required for the commissioning of the purchased virtual or physical server service is free of charge.

B. Physical servers are re-installed free of charge once a year except for the initial installation, and a fee is charged for installations other than this.

C. The installation of control panel software purchased from Gyro Hosting Hizmetleri on the operating system is done free of charge and only once.

D. While the use of control panel software purchased from Gyro Hosting Hizmetleri is provided by the customer, Gyro Hosting Hizmetleri will provide paid support for any malfunctions that may occur in these panels. Support for the use of control panel software is not provided by Gyro Hosting Hizmetleri. All requests for additional installation, optimization, configuration, etc. will be provided for an additional fee.

E. The responsibility for malfunctions that may occur in operating systems belongs to the customer and ensuring that the customer can access the server remotely due to these malfunctions. k The necessary operations for this are provided by the Gyro Information Services personnel. (kvm over ip, console access, etc.) should be resolved by the customer. If requested, operating systems can be restarted in rescue mode in various operating systems.

F. Failures occurring in physical servers are checked by the Gyro Information Services technical support personnel, and the faulty physical server components are replaced with new ones. If the failure cannot be resolved, the same server or an equivalent server in the Gyro Information Services stocks is allocated to you. The technical support personnel does not give you an estimated time for resolving the problem. If the server's operating system or the control panel purchased from Gyro Hosting Hizmetleri needs to be reinstalled due to this problem, this installation is done free of charge.

G. Technical support is provided by Gyro Hosting Hizmetleri for problems with internet access on virtual or physical servers. However, if the internet access interruption is due to the operating system on the server, running applications and/or user errors, technical support will be provided by Gyro Hosting Hizmetleri technical staff upon request in cases where a solution is possible.

H. Gyro Hosting Hizmetleri offers attack-protected IP according to the type of attack regarding internet attacks coming to your server. The technical details of this service are available on our website. If you do not have a firewall service, Gyro Hosting Hizmetleri does not provide technical support for blocking the attack. However, upon request, providing log records of incoming attacks, closing the IP address and temporarily blocking the IP address from international access are provided through legal means.

Limitations
Limitations regarding servers are listed below.

A. Rental servers

Changes to be made to the hardware components of rental servers are available on our website. No changes are made to the rental server packages on our website, other than valid components such as RAM and disk.

It is strictly forbidden to send any external device and/or physical components belonging to the customer to the data center and install them on the rental servers.

The traffic quota for internet access on rental servers is shared as 100 mbit/s on 1 gbps port and limited to a monthly quota of 10 tb. When a monthly usage of more than 10 tb is made, a burst limit exceeding fee of 0.09 krş + VAT will be charged on the 1st of each month, and the responsibility for using the provided service within the limits belongs to the customer.

The customer is not responsible for the failures of the rental hardware belonging to Gyro Hosting Hizmetleri. In addition, since the customer is responsible for ensuring their own data security and keeping backups, they hereby undertake not to hold Gyro Hosting Hizmetleri responsible for any damages arising from hardware failures. All parts of the rental hardware are replaced free of charge by Gyro Hosting Hizmetleri or, if the required part or server is not available, they are replaced with an equivalent part or server.

If Gyro Hosting Hizmetleri is an intermediary in the service it provides to the customer, Gyro Hosting Hizmetleri is not responsible for hardware failures. The customer hereby undertakes not to hold Gyro Hosting Hizmetleri responsible for any material or moral damages that may occur as a result.

B. Vps virtual servers

Changes to be made to the package features of the Vps virtual server service are available on our website. No changes are made to the vps virtual server packages on our site other than the valid features.

Virtualization is done in vps virtual servers by software. The limits given to the virtual server can be technically exceeded due to maximum usage. In case of maximum usage or usage above the limits, Gyro Hosting Hizmetleri has the right to intervene in the user's server.

The traffic quota related to internet access in vps virtual servers is clearly stated in the details of the purchased service. In case the traffic package quota clearly stated in the service details is exceeded, the exceeded amount will be charged. Information about this charge is available on our website.

The customer is obliged to use the services they receive in a way that will not harm other users. In case of detection of such usage, Gyro may warn the customer and request correction or may temporarily suspend the service without informing.

For customer satisfaction in VPS virtual servers In order to prevent resource distribution problems that may occur in the future, your virtual server can be moved to a different virtualized main server with the same infrastructure. This move can be done by Gyro Hosting Hizmetleri when deemed necessary within the scope of planned maintenance work. In case of any interruptions that may arise due to this move, Gyro Hosting Services will notify you in advance and since these interruptions are made within the scope of planned maintenance work, they are outside the uptime guarantee, the responsibility for using the provided service within the limits belongs to the customer.

C. VDS and SSD Virtual Servers

Changes to be made in the package features of the vds and ssd vds virtual server service are available on our website. No changes are made to the vds and ssd vds virtual server packages on our site other than the valid features.

The traffic quota for internet access in vds and ssd vds virtual servers is clearly stated in the details of the purchased service. If the traffic package quota clearly stated in the service details is exceeded, the exceeded amount will be charged. Information about this charge is available on our website.

In vds and ssd vds virtual servers, your virtual server can be moved to a different virtualized host server with the same infrastructure in order to prevent future resource distribution problems for customer satisfaction. This transfer can be done by Gyro Hosting Hizmetleri as part of planned maintenance work when deemed necessary. In case of any interruptions that may occur due to this transfer, Gyro Hosting Hizmetleri will notify you in advance and since these interruptions are made within the scope of planned maintenance work, they are outside the uptime guarantee. The responsibility for using the provided service within the limits belongs to the customer.

Payment Information
In virtual server or rental server services, the payment period including license fees such as cpanel and litespeed is tolerated as a maximum of 2 days. If the customer does not pay in more than 2 days, the server is completely shut down and all data is deleted. Our company is not responsible for any problems that may arise due to this reason.
